Fifth Third Bank Issuing New Credit and Debit Cards After Heartland Payment Systems Data Theft

From the Louisville Courier-Journal:

"Fifth Third Bank is among financial institutions across the U.S issuing new credit cards and debit cards following the theft of transaction data earlier this year from payment processor Heartland Payment Systems.

“We have been dealing with this for some time,” Fifth Third Bank spokeswoman Deborah Decorcy said of notices sent to customers recently that a new card would be issued.

The company couldn't immediately provide how many customers were affected at Fifth Third.

Heartland, of Princeton, N.J., processes up to 100 million transactions monthly for financial institutions."

Heartland Payments Systems Data Breach Results in Identity Theft of Kentucky Residents

From KFVS12 Hearland News:

"Is your account information among 100 million possibly exposed after one of the biggest security breaches in history?  It happened at Heartland Payment Systems based in New Jersey.

On January 20th the company announced more than 100 million accounts could have been exposed.  So far, more than 370 bank institutions have been impacted.

Heartland News has heard from lots of people in Missouri, Illinois, and Kentucky saying they got a letter from their bank and now they have to wait for new bank cards.

In most cases, this is just a pro-active approach by the banks trying to protect their customer's information before there's a proble.

As more instiutions learn they could have been hit, banks advise keeping a close eye on your accounts.

Heartland is the nation's largest payment processors delivering credit/debit/prepaid card processing, payroll, check management and payments solutions.  It acts as a middleman for authenticating and processing credit and debit card transactions between commericial entities like retail outlets and restaurants and the financial institutions that issue the credit and debit cards to people."

Heartland Payments Security Breach

From the Louisville Courier-Journal:

"Employees at Heartland Payment Systems in Southern Indiana were not responsible for a security breach at the company that exposed the names and credit card numbers of customers, a spokesman said yesterday.

The breach also shouldn't have any negative long-term impact on the approximately 550 people who work at the processing center in Jeffersonville, spokesman Jason Maloni said in an interview.

The facility, off Port Road and Ind. 62, is primarily a call center, and Maloni said there could be additional call volume in the coming weeks from customers concerned about the status of their financial information.

Technology security experts predicted this week that the breach could set a record. Retail giant TJX lost 94 million customer records to hackers in 2007. With more than 100 million transactions per month at Heartland, the New Jersey-based company could discover that several months' worth of transactions were captured, said Michael Maloof, chief technology officer at TriGeo Network Security.

Heartland President Robert H.B. Baldwin Jr. said the company found evidence of the intrusion last week and immediately notified federal law enforcement officials as well as Visa and MasterCard.

Baldwin said the only information breached involved card numbers and cardholders' names, or one or the other. Heartland processes card payments for restaurants, retailers and other merchants, including banks. Shares of the company's stock lost 42 percent of their value yesterday, closing at a 52-week low of $8.18."

Helpful Q & A Regarding Heartland Payment Systems Security Breach & Data Loss

The following Q & A is from USA Today's technology blog:

"Don't expect a letter from Monster or Heartland Payment Systems letting you know they've lost your data. The breaches at Monster.com and Heartland Payment Systems are raising questions about the efficacy of data-loss disclosure laws enacted in at least 45 states.

Back in 2007 we wrote about how the financial services industry lobbied hard to block proposed federal rules requiring organizations to notify individuals whose data they lose, and to permit consumers to freeze their credit histories.

States such as California and Massachusetts have passed laws giving consumers these rights. But the Monster and Heartland capers have brought weaknesses in the legislation to center stage. I asked Lisa Sotto, head of privacy and information management at law firm Hunton & Williams, about this:

Q: Heartland and Monster told me they intend to comply with all state laws. That said, they have not announced plans to notify individual victims. Is that OK?

A: In the state breach notification laws, it is permissible to delay notification if a law enforcement agency determines that notification would impede a criminal investigation.  If such a delay is requested by law enforcement, notification must be made after the law enforcement agency determines that notice would not compromise the investigation.  I do not know if these companies received a delay request from a law enforcement agency.

...

Q: The only official notices from Heartland and Monster so far has been one-page disclosures posted on a web site. Does that cover them?

A: There are provisions in the state laws allowing for "substitute notice" if the number of individuals required to be notified exceeds a certain number (which differs by state), if the cost will exceed a certain dollar amount (which also differs by state), or if the business seeking to notify does not have sufficient contact information for the affected individuals. If substitute notice is used, the notifying party generally must send an email to the affected individuals if the notifying party has email addresses, post a notice on the web site page of the notifying entity, and notify media.
