A Protivin (PRO-tuh-vuhn) woman is suing a trucking company involved in a deadly crash that killed her two children in December 2006.
Nicole Sanders filed the lawsuit against Lee Steyer Trucking of Soldiers Grove, Wis., and driver William Creager, of Westby, Wis., in U.S. District Court in Cedar Rapids.
Sanders' children, 3-year-old Raven Williams and 2-year-old Wesley Williams, died in the crash on U.S. Highway 63 near New Hampton.
Authorities say Sanders' vehicle lost control on the icy highway and collided with a van. Both vehicles came to rest in the road before being struck by the semitrailer driven by the Wisconsin driver.

From the Associated Press, the National Transportation Safety Board ("NTSB") has recommended that both trucking companies and the Federal Government should take measures to address safety concerns over driver fatigue and exhaustion.
The hearing came about in response to a tragic accident in Wisconsin three years ago in which 5 people where killed when school bus carrying school band members crashed in an overturned tractor-tractor whose driver fell asleep at the wheel.
The NTSB called for trucking companues to take measures to ensure that it drivers get enough rest. Furthermore, it called for the government to step up its enforcement of safety regulations such as requiring trucking companies to keep detailed records and ensuring their drivers get enough rest.

A Michigan Trucking company recently entered into an $18 million dollar settlement before punitive damages could be determined after a jury found for the plaintiffs in the amount of $15 million in compensatory damages.

The study, published in the International Journal for Vehicle Safety notes that three "critical manoeuvers" lead to the loss of control preceding a tractor-trailer, truck, or semi accident. Those manoeuvers being (1) bend-negotiation (2) avoidance manoeuvers, and (3) road-edge recovery.

This article from the New York Times highlights the confusion often experienced by patients who have made emergency room visits. The article is concerned with a recent study that followed a group of E.R. patients and measured their understanding of 1.) their diagnosis 2.) their E.R. treatment 3.) their home care instructions and 4.) the warning signs signaling a need to return to the hospital.
The results of the study are unfortunate. Of the surveyed patients, 78% did not understand at least one of those areas and about half did not understand two or more areas. This is especially concerning as failure to understand these areas could lead to further and potentially life-threatening injuries for patients. Hospitals and their staff need to take special notice of the results of this study, and need to redouble their efforts to ensure that all patients not only get the necessary medical information critical to their further care and treatment but understand it as well.

From the New York Times: Medicare recently began applying a congressional mandate that it will no longer pay hospitals for the added costs of treating patients who are injured in the hospital's care.
An initial list of incidents that Medicare deemed "reasonably preventable" and will not pay hospitals for these occurrences includes; incompatible blood transfusions, sponges left in after procedures, serious bed sores, hospital falls, and urinary tract infections caused by catheters.
The Times article adds that other insurers have enacted similar provisions, such as Medicaid denying payment for so-called "never events", events that are never supposed to happen under a hospital's care.

From the Seattle Post-Intelligencer: a Federal lawsuit alleges among other claims that a group of Washington state nursing homes regularly took on patients that they could not properly care for in order to boost profits.
The lawsuit names as a defendant a company that runs 15 nursing homes in the Washington area. From Bloomberg.com, Pfizer has agreed to settle many of the the pending lawsuits against the company claiming injuries from the use of its products, Celebrex and Bextra. Although this settlement agreement has yet to be approved by any Court, Pfizer announced that it is prepared to pay approximately $894 million to resolve over 90% of the pending lawsuits regarding these products.
The lawsuits alleged that painkillers Celebrex and Bextra caused heart attacks and strokes.

Franklin Gray & White Obtains Settlement for Girl Seriously Injured in Six Flags Kentucky Kingdom Accident:
On June 21, 2007, Kaitlyn Lasitter, then 13, was riding the Superman Tower of Power ride at Six Flags Kentucky Kingdom with friends, when a cable broke seriously injuring her and severing her feet.
